Sixth. Miscellaneous.
This Agreement will be governed and interpreted in accordance with the laws of the United States of America that apply to agreements made and to be executed in the United States of America. You agree that any legal action or procedure conducted between Daily Health and you for any reason relating to this Agreement or the parties' duties hereunder will be brought only in a federal or state court of competent jurisdiction sitting in The United States of America. Any cause of action or claim you may have with regard to the Service must be brought within one (1) year of the occurrence of the claim or cause of action, otherwise the claim or cause of action will be barred. Failure by BeVital to insist on or enforce strict compliance with any term of this Agreement shall not be interpreted as a waiver of that provision or right. Neither the parties' course of conduct nor trade practice may be used to change any term of this Agreement. Daily Health reserves the right to delegate its rights and responsibilities under this Agreement to any third party at any time and without notice to you.
Any rights not explicitly granted in this document are reserved.
